Abstract

An acceptable standard of care in medical practice, including histopathology, is both a professional and legal requirement, yet its definition is increasingly challenged by rapid technological advances, including molecular testing, digital pathology and artificial intelligence, alongside evolving diagnostic thresholds. Although the interpretative nature of histopathology and its inherent diagnostic variability are well recognised, the implications of this variability for medicolegal assessment remain insufficiently conceptualised. Using breast pathology as a model, this review examines the medicolegal challenges of retrospective diagnostic assessment, in which subspecialist experts may be influenced by hindsight and knowledge of clinical outcomes, creating unrealistic expectations for the original reporting pathologist. We synthesise existing pathological, professional, and legal principles into a structured conceptual approach for evaluating the reasonableness of histopathological diagnoses. This approach integrates adherence to professional guidance with the "reasonable pathologist" peer standard and is informed by three key principles: reasonable competence within the relevant professional role, the diagnostic context at the time of reporting, and recognised diagnostic variability. Within this framework, we describe a conceptual contextual diagnostic standard that shifts the focus from identifying a single retrospectively optimal diagnosis to recognising a range of diagnostically reasonable interpretations supported by a responsible body of similarly competent practitioners working under comparable conditions. By aligning medicolegal assessment with the realities of contemporary pathology practice, this conceptual pathology-based framework may support more consistent expert opinion, facilitate defensible clinical decision-making, and provide a structured basis for evaluating histopathological performance.
